1. Introduction
Marketcall Inc. ("HomeProMatcher," "we," "our," or "us") operates a pay-per-call and pay-per-lead advertising platform (the "Platform"). This Privacy Policy describes how we collect, use, share, and protect information in connection with the Platform. It applies to advertisers who register and use the Platform, as well as to consumer data that flows through the Platform in the course of call and lead delivery.
By using the Platform, you agree to the practices described in this Privacy Policy. For the Terms governing your use of the Platform, see our Terms of Service.
2. Information We Collect
Advertiser Account Information: When you register, we collect your name, business name, email address, phone number, business address, vertical/industry, and any other information you provide during the registration and onboarding process.
Campaign and Usage Data: We collect information about your campaign configurations (targeting, bids, budgets, hours of operation), campaign performance data, and your activity on the Platform (pages visited, features used, login history).
Billing Information: Payment transactions are processed by our PCI-DSS-compliant third-party payment processor; Marketcall Inc. is the merchant of record. We do not store full payment card numbers. We receive transaction records from our payment processor, including transaction IDs, amounts, and billing contact details.
Call Recordings and Transcripts: All calls delivered through the Platform are recorded via Twilio. Recordings may be transcribed by AssemblyAI. We retain recordings and transcripts for quality assurance, compliance, and dispute resolution. See Section 6 for details.
Consumer Lead and Caller Data: In the course of routing calls and leads, the Platform processes consumer data including phone numbers, state, zip code, and vertical/category. This data is transmitted to matched advertisers as part of the service. We are not the original collector of this data from consumers.
Log and Technical Data: We automatically collect IP addresses, browser type, operating system, referring URLs, and timestamps when you access the Platform.
Cookies and Analytics: We use cookies and similar tracking technologies for authentication, security, and to understand how the Platform is used. See Section 7 for details.
3. How We Use Information
We use the information we collect to:
- Operate, maintain, and improve the Platform;
- Process account applications and manage advertiser accounts;
- Route and deliver qualified calls and leads to matched advertisers;
- Process payments and manage prepaid account balances through our payment processor;
- Investigate and resolve disputes using call recordings and transcripts;
- Monitor for fraud, abuse, and regulatory compliance;
- Send transactional communications (account notices, billing receipts, dispute updates);
- Send platform-related communications and product updates (you may opt out of non-transactional communications);
- Comply with legal obligations and respond to lawful requests from authorities.
4. Legal Bases for Processing (GDPR)
If you are located in the European Economic Area (EEA) or United Kingdom, our legal bases for processing your personal data are:
- Contract performance: processing necessary to provide the Platform services you have registered for;
- Legitimate interests: fraud prevention, security, platform analytics, and improving our services;
- Legal obligation: compliance with applicable laws and regulatory requirements;
- Consent: for any processing where we have requested your consent (e.g., marketing communications).
5. Sharing and Sub-Processors
We do not sell your personal data. We share data only as described below:
Payment processor: Payment card data and billing information are transmitted to and processed by our PCI-DSS-compliant third-party payment processor under its own privacy policy. We do not store full card numbers.
Twilio (telephony and call recording): Calls delivered through the Platform are connected and recorded using Twilio Inc.'s infrastructure. Call audio and associated metadata (phone numbers, timestamps, call duration) are transmitted to Twilio.
AssemblyAI (transcription): Call recordings may be sent to AssemblyAI for automated transcription. AssemblyAI processes audio data to produce text transcripts used for dispute resolution and compliance review.
Email and notification providers: We use third-party email delivery services to send transactional and platform notification emails.
Web analytics providers: We use standard analytics tools to understand Platform usage. These providers may set cookies and receive usage data.
Advertisers (consumer lead data): Consumer caller data (phone number, state, zip code, vertical) is transmitted to matched advertisers as a core function of the Platform. Advertisers receive this data subject to our Terms of Service and applicable law.
Legal and regulatory: We may disclose data to law enforcement, courts, or regulators when required by law or to protect the rights and safety of HomeProMatcher, advertisers, or the public.
Business transfers: In connection with a merger, acquisition, or sale of assets, data may be transferred to the successor entity, subject to the same protections described in this Policy.
6. Call Recordings
All calls delivered through the Platform are recorded. This is a core feature of the Platform used for quality assurance, dispute resolution, and compliance monitoring. By registering as an advertiser, you acknowledge and consent to the recording of calls delivered to you via the Platform.
Call recordings and transcripts may be accessed by HomeProMatcher staff for the purposes described above. Recordings are stored securely and retained for a period consistent with our data retention practices (Section 8). Recordings may be reviewed if a dispute is filed or if we receive a compliance inquiry.
Advertisers are separately responsible for complying with applicable call-recording disclosure laws (e.g., two-party consent states) in their own handling of calls.
7. Cookies and Tracking Technologies
We use cookies and similar technologies (local storage, session tokens) to:
- Authenticate your session and maintain your login state;
- Protect against cross-site request forgery and other security threats;
- Analyze Platform usage through analytics providers.
You can control cookies through your browser settings. Disabling cookies may affect Platform functionality, including the ability to remain logged in.
8. Data Retention
We retain personal data for as long as your account is active and as necessary to provide the Platform services, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention practices:
- Account data: retained for the life of your account and for a reasonable period thereafter (typically up to 3 years) to comply with legal and tax obligations;
- Call recordings and transcripts: retained for a period sufficient to cover the dispute window and any ongoing compliance or legal matters, typically up to 2 years;
- Billing records: retained for at least 7 years as required by financial record-keeping regulations;
- Log and technical data: typically retained for 90 days.
When data is no longer needed, we delete or anonymize it in accordance with our internal data management procedures.
9. Security
We implement industry-standard technical and organizational measures to protect your data against unauthorized access, loss, or disclosure. These include encrypted data transmission (TLS), access controls, and regular security reviews. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your account credentials.
10. International Data Transfers
HomeProMatcher is based in the United States. If you access the Platform from outside the United States, your data will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Sub-processors (Twilio, AssemblyAI, our payment processor) may also process data in other countries. Where required by law (e.g., GDPR), we implement appropriate safeguards such as Standard Contractual Clauses for international transfers.
11. Your Rights
For EEA/UK users (GDPR): You have the right to access, correct, or delete your personal data; the right to restrict or object to certain processing; the right to data portability; and the right to lodge a complaint with a supervisory authority. To exercise these rights, contact us.
For California residents (CCPA/CPRA): You have the right to know what personal information we collect and how it is used and shared; the right to delete your personal information (subject to exceptions); the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information (we do not sell personal information); and the right to non-discrimination for exercising your rights. To submit a request, contact us or use the tools in your account dashboard.
We will respond to verified requests within the timeframes required by applicable law. We may need to verify your identity before processing a request.
12. Children's Privacy
The Platform is intended exclusively for business use by persons 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected data from a person under 18, we will take steps to delete it promptly.
13. Links to Third-Party Services
The Platform may contain links to third-party websites or services (including our payment processor's pages). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any information.
14. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will notify you of material changes by posting the updated Policy on the Platform and updating the "Last updated" date above. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Policy.
